Governing access to emfoundation.net and all tools made available through it.
These Terms of Use ("Terms") govern your access to and use of emfoundation.net and all tools, services, and content made available through it, including but not limited to the Multi-Model Deliberation Engine ("MMDE"), CR-Lite, and any successor or related tools (collectively, the "Services"). The Services are operated by EM Foundation for AI Research Inc. ("EM Foundation," "we," "us," or "our"), a Texas nonprofit corporation.
This page is the published version of the same Terms presented inline within MMDE before each new session. By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
This tool is provided for research and educational purposes only. Outputs are generated by third-party AI models and do not constitute legal, medical, financial, or professional advice of any kind.
Do not submit personally identifiable information (PII), protected health information (PHI), classified material, or content that violates applicable law. Session prompts are transmitted to third-party AI providers and are not retained by the EM Foundation.
Session cost estimates are calculated from last-known per-token pricing for each AI model and quantum processing tier. These prices are set by third-party providers and may change without prior notice. Actual costs may vary. The EM Foundation is not responsible for discrepancies between estimated and actual charges.
Multi-model deliberation consumes more compute than single-model queries. Select only the models necessary for your research. The EM Foundation is committed to responsible and purposeful AI use.
The Multi-Model Deliberation Engine architecture is covered by USPTO Provisional Patent Application #64/081,329. Deliberation outputs belong to the user. The EM Foundation retains no rights to session content.
The EM Foundation provides this tool as-is without warranty. Use is at your own risk. The Foundation shall not be liable for any direct, indirect, or consequential damages arising from use of this tool or reliance on its outputs.
EM Foundation has filed an application for recognition of exemption under Section 501(c)(3) of the Internal Revenue Code (Form 1023-EZ).
This matters directly to anything described in these Terms as a "donation":
We will update this section, and all related disclosures across our Services, promptly upon receiving a final determination from the IRS.
Certain Services, including MMDE, are made available on a pay-per-use basis through a third-party payment processor (currently Stripe).
Each session is subject to a minimum charge (currently $0.50 USD, subject to change with notice on this page) regardless of the actual AI provider cost incurred. This minimum exists to cover payment processing fees and baseline infrastructure costs that apply to every session regardless of size.
Where the actual AI provider cost for your session is less than the minimum charge, the difference is treated as a donation to EM Foundation in support of its nonprofit research mission. This is a condition of using the paid tier of these Services, not an optional add-on — by completing payment, you agree that any unused portion of the minimum charge is donated to EM Foundation. If you do not wish to make this donation, do not complete payment or use the paid tier of the Services.
Because the unused portion of the minimum charge is treated as a donation under Section 8.2, it is not refundable. Separately, if you experience a technical failure that prevents your session from running at all (for example, a payment that succeeds but a session that never starts due to a system error), contact us at hello@emfoundation.net and we will address it on a case-by-case basis. This is a service-failure remedy, not a right to a partial refund of an unused minimum on a session that otherwise ran successfully.
After each paid session, you will be shown or sent an itemized record showing the amount charged, the actual AI provider cost incurred, and the amount treated as a donation under Section 8.2. This record reflects EM Foundation's own accounting of the transaction. See Section 7 regarding the current limits on what this record can establish for tax purposes.
You agree not to use the Services to:
We reserve the right to suspend or terminate access for violation of these terms.
The Services route your queries to third-party AI providers (currently including Anthropic, OpenAI, Google, xAI, and DeepSeek, and may include others over time). Each provider's own terms of service, privacy policy, and data handling practices apply to your submitted content once it reaches their systems, independent of anything stated here. EM Foundation does not control, and is not responsible for, the content, accuracy, availability, or data practices of any third-party AI provider's output.
Output from these Services may be inaccurate, incomplete, or reflect the limitations and biases of the underlying AI models. Nothing generated by the Services constitutes professional advice of any kind, regardless of how the output is framed or what role-based persona a tool's deliberation structure assigns to a given model.
We may update these Terms from time to time, particularly as our tax-exempt status changes, as pricing or minimums change, or as new tools are added. The version number and effective date at the top of this page reflect the current version. Material changes will be reflected in the version history maintained on this page. Continued use of the Services after a change takes effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles, except where applicable federal law (including federal tax law referenced in Section 7) governs.
